Welcome to Yako by the Sea (the “Service”), a free, ad‑free educational game for children created by Jacob “Yako” Tanzer in Carmel‑by‑the‑Sea, California, available at yakobythesea.com. By accessing or using the Service, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use the Service. These Terms work together with our Privacy Policy.
The Service is intended for use by children with the involvement, supervision, and consent of a parent or legal guardian. If you are a parent or guardian, you agree to these Terms on behalf of yourself and any child you allow to use the Service, and you are responsible for their use. If you are under the age of majority, you may use the Service only with a parent’s or guardian’s permission and supervision.
We grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Service for personal, non‑commercial, educational and entertainment purposes. The Service and its content — including the “Yako by the Sea” name, characters, artwork, background scenes, music, voice narration, text, and software — are owned by the creator or its licensors and are protected by intellectual‑property laws. Some artwork and voice content were generated with AI tools during development (see the Privacy Policy). All rights not expressly granted are reserved.
The Service is provided for learning and entertainment. Some content is AI‑generated and may occasionally contain inaccuracies or imperfections. The Service is not a substitute for professional educational instruction, and no specific learning outcome is guaranteed. Adults should supervise children’s use, screen time, and volume.
The Service may rely on or link to third‑party services (such as hosting, fonts, analytics, and optional sign‑in). We are not responsible for the content, policies, or practices of third parties, and your use of them is governed by their terms.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, secure, or free of harmful components, or that content is accurate or complete. To the maximum extent permitted by law, our total aggregate liability for any claims relating to the Service will not exceed one hundred U.S. dollars (US $100) or the amount you paid us to use the Service (which, for a free service, is zero), whichever is greater.
You agree to defend, indemnify, and hold harmless the creator of Yako by the Sea and its affiliates and contributors from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms.

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict‑of‑laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California, to the extent permitted by law.
